RenaissanceButterflies.com is owned and operated by Greathouse Butterfly Farm Inc, doing business as (dba) Renaissance Butterflies.

Effective January 1st, 2008, the following terms and conditions apply to all orders. When you place your order, you, the customer, acknowledge and agree that you have read,  understand, and will be bound by the following terms and conditions:   

I.          Live Butterfly Guarantee:

Greathouse Butterfly Farm Inc. dba Renaissance Butterflies (hereinafter referred to as GBFI) guarantees that you will receive live,  healthy butterflies for your event release. In continued pursuit of the excellent customer service, GBFI  is known for, we will always include extra butterflies with each order. In the rare event that some butterflies arrive expired, GBFI will issue a pro-rated refund per butterfly if the customer adheres to the following procedures:

A refund will be issued only if the expired butterflies are returned to GBFI within seven (7) days of your event date. Package containing expired butterflies must be postmarked within 7 days from event date in order to qualify for prorated refund. Only butterflies actually purchased (extra/free/complimentary butterflies will not be included) are eligible for prorated refund. First class mail is acceptable. GFBI reiterates that it will not issue a refund under any circumstance unless the expired butterflies themselves are physically returned to GBFI within the aforementioned time period.


II.          Arrival Guarantees:

Subject to the following exceptions, GBFI guarantees that the butterflies will arrive on time for your event.
 

    a.         Shipping Company Negligence

If your order arrives late or is delayed due to negligence of the shipping company you (the customer) agree not to hold GBFI responsible for the late order and you understand that no refund will  be issued for such an order. An example of this exclusion would be when a shipping company delivers the package to a address different than the one specified or if, for any reason, the shipping company is unable to deliver the package on time.  The customer acknowledges that GBFI will not issue a refund for the order, but may, under certain circumstances, issue a refund for the  shipping charges alone.  GBFI can only receive a refund from the shipping company for the shipping costs itself and not for any value of the order if the butterflies do not arrive on time or arrive at all. Therefore, only the shipping costs will be refunded to the customer. It should also be noted that shipping insurance cannot be purchased for the orders because the shipping company will not insure the transit of live animals or any perishable goods. This is the shipping companies’ policy. In order to obtain a refund for the shipping charges on any order that does not arrive on time or does not arrive at all, you, the customer, must notify GBFI within three hours of the shipping company's guaranteed delivery time via email notification to carmella@RenaissanceButterflies.com.  Notification within this time frame  will afford GBFI the best opportunity to replace the order if at all possible and as satisfied customers are our goal, every effort will be made to resend the order.

    b.         Customer Negligence

If the customer provides GBFI with an incorrect or incomplete address, then GBFI accepts no responsibility for the order. Additionally, no refund will be issued for the butterflies or shipping costs. 

    c.        Miscellaneous Exclusions

If your order arrives late, is delayed or does not arrive at all due to an act of God, you (the customer) agree not to hold GBFI responsible for the late order and you understand that no refund will be issued for such an order.   Examples include weather related delivery issues such as grounded planes, road closures, hurricanes, tornadoes and ice storms. Additionally, similar exclusions apply should any order arrive late, become delayed or fail to arrive at all as a result of acts of terrorism that result in airport closures, grounded planes, road, bridge and/or tunnel closures or any other circumstance that prevent delivery of an order. This miscellaneous exception applies to all orders once they have left our facility.


III.         Weather Guarantee and Cancellations:

GBFI allows weather related cancellations without any penalty. The cancellation must be made six (6) shipping days prior to the event date. For example, if the event is on a Saturday, the cancellation must be made by Monday 5pm, EST. Cancellations must be made via email and those requests must be sent to carmella@RenaissanceButterflies.com.  Weather conditions however, will be verified by GBFI . If weather conditions are indeed unfavorable, GBFI will issue a complete refund for the order with no penalty. Any weather related cancellation made less than 6 shipping days prior to the event date will result in a 50% (of order total) cancellation fee. If the customer chooses not to cancel the order due to weather conditions or fails to check on weather conditions, then the customer will not hold GBFI responsible for the order. GBFI assumes no responsibility and no refund will be issued if the butterflies are unable to fly because of the weather (cold, rain, dark etc.).


IV.         Non-Weather Cancellations:

A 25% cancellation fee will be applied to the order total for all non-weather related cancellations.  However, a 50% cancellation fee will be applied to order total for non-weather related cancellations made within 10 days of the event date.


V.         No Returns Allowed:

Live butterflies cannot be returned to our company.
 

VI.       Other Issues Pertaining to Orders:

Customer must contact GBFI within three (3) business days of the event to report any errors with the order, (received the wrong package,  wrong butterflies, incorrect packaging, etc). GBFI will make a price adjustment.  An email ( carmella@RenaissanceButterflies.com), letter in the mail (postmarked within 3 business days of the event date) or phone message will be sufficient. Also note if the customer contacts GBFI immediately upon receipt of the order and explains the error, GBFI will make every effort to correct the issue.

VII.     Pricing:

GBFI reserves the right to change prices without notice. Prices change throughout the season, usually due to unforeseen weather circumstances. Also, prices are generally higher during summer months due to a higher demand from our wedding clients. With our facility being located in the heart of Florida, prone to hurricanes and other weather storms, we recommend ordering your butterflies as early as possible. If prices increase, you will NOT be charged for the increased prices. If prices are decreased during the week of your scheduled release, we can adjust your order to include more butterflies, but we will not discount your original order. If we cannot accommodate the sending of additional  butterflies because of demand, we will gladly discount the price of your order. You must contact us during the week of your scheduled release for any changes to be made. We will not under any circumstance alter the order after the order has been shipped if you, the customer, fail to contact us in advance.

  

VIII.     Refunds:

All credits, refunds or adjustments (in accordance with the above terms and conditions) will be issued only by the payment method originally used when  placing the order and will generally be issued within ten (10) business days.

 

IX.     Substitution of Butterflies:

Each Renaissance Butterflies customer, by placing an order, thereby acknowledges that the transport and release of live butterflies is an activity governed by federal, state and/or local laws. Each customer further acknowledges that GBFI reserves the right to substitute any species of butterfly for any other purchased in order to  comply fully with federal, state and local requirements. Each Renaissance Butterflies customer, by placing an order, therein agrees to allow GBFI to make such substitutions with no prior notification and will not hold GBFI liable for species substitutions as required by law.
